Terms & Conditions
These Terms & Conditions govern your access to and use of the Titan Capital website and describe the general terms applicable to information about and access to Titan Capital's brokerage services.
1. Introduction
Titan Capital (Private) Limited, referred to in these Terms & Conditions as “Titan Capital”, “we”, “us” or “our”, is a company incorporated in Pakistan.
References to “you” or “your” mean any person accessing this website or, where applicable, a prospective or existing client of Titan Capital.
By accessing or using this website, you agree to comply with these Terms & Conditions to the extent applicable to your use of the website. If you do not agree with these terms, you should discontinue using the website.
Your use of brokerage services and any PMEX trading account may also be governed by separate account-opening documents, client agreements, risk disclosures, applicable policies, and the rules and procedures of Pakistan Mercantile Exchange Limited (PMEX) and the relevant authorities.
If there is any inconsistency between these website terms and a mandatory legal or regulatory requirement, the applicable law or regulatory requirement will prevail. The specific contractual documents and applicable exchange rules will govern matters relating to trading accounts and transactions to the extent legally applicable.
2. Regulatory Status and Scope of Services
Titan Capital intends to provide commodity futures brokerage services through the applicable regulatory and exchange framework, subject to the authorizations, permissions, and requirements applicable to its operations.
Titan Capital's services are limited to those it is legally authorized and operationally permitted to provide. Information on this website must not be interpreted as evidence of an authorization, approval, or permission that has not actually been granted.
PMEX is the relevant exchange for the commodity futures brokerage services described on this website. References to PMEX do not imply that PMEX endorses Titan Capital's website, marketing materials, or statements unless such endorsement has been expressly confirmed.
The website may contain general information about commodity futures markets, available instruments, account opening, trading platforms, and brokerage services. The availability of any service or instrument is subject to applicable rules, eligibility requirements, exchange arrangements, and operational availability.
Titan Capital does not guarantee that every product, trading instrument, platform, or service described on the website will be available to every user.
3. Website Information and Permitted Use
We aim to keep the information on this website accurate and current. However, information may change, become outdated, or contain inadvertent errors or omissions.
Website content is provided for general informational purposes. Unless expressly stated otherwise in an applicable agreement, it does not constitute an offer to enter into a transaction, a personalized investment recommendation, or a guarantee of any market outcome.
You agree to use this website lawfully and responsibly. You must not:
- Use the website in violation of applicable law or regulatory requirements.
- Attempt to gain unauthorized access to our systems, accounts, infrastructure, or data.
- Introduce malicious software, interfere with website functionality, or attempt to circumvent security controls.
- Submit false, misleading, fraudulent, or unauthorized information through website forms.
- Copy, reproduce, distribute, or commercially exploit website content without authorization, except where permitted by law.
- Use the website in a way that could impair its availability, security, or operation for other users.
We may take reasonable measures to protect the website, investigate suspected misuse, and restrict access where necessary and legally permissible.
4. Intellectual Property
Unless otherwise indicated, the website's text, design, branding, graphics, and other materials are owned by Titan Capital or used under applicable permission or license.
You may access and use website content for your personal, informational, and lawful purposes.
You may not reproduce, modify, republish, distribute, or commercially exploit our content or branding without prior authorization, except as permitted by applicable law.
Nothing in these Terms & Conditions transfers ownership of intellectual property to you.
Third-party names, trademarks, logos, and product references remain the property of their respective owners.
5. Eligibility and Account Opening
Access to brokerage services is subject to applicable eligibility requirements, identity verification, regulatory requirements, and the procedures established by Titan Capital and PMEX.
Prospective clients may be required to provide identification documents, contact information, financial information, source-of-funds information, tax information, declarations, and other documents reasonably required for account opening and ongoing compliance.
You agree to provide complete, accurate, current, and genuine information and to update material changes when required.
Submitting an account-opening request does not guarantee account approval or immediate access to trading services.
Titan Capital may request additional information, conduct verification checks, defer an application, or decline to proceed where permitted or required by applicable law, regulatory requirements, exchange rules, or its documented onboarding procedures.
Account opening and trading access are subject to the applicable client agreements, PMEX requirements, and any required approvals or activation procedures.
6. Client Responsibilities
As a client, you are responsible for:
- Providing accurate and complete information during onboarding and throughout the client relationship.
- Ensuring that the funds used for trading are lawfully sourced and that their use complies with applicable law.
- Reviewing the applicable client agreement, risk disclosures, product specifications, charges, and trading rules before trading.
- Understanding the risks of commodity futures trading and the possibility of losing money.
- Maintaining the confidentiality of your login credentials, passwords, authentication codes, and other security information.
- Monitoring your positions, available margin, account balance, open orders, and trading activity.
- Maintaining sufficient funds and meeting applicable margin and settlement obligations.
- Promptly notifying the relevant support channel if you suspect unauthorized access, account compromise, or incorrect transaction information.
- Complying with applicable laws, PMEX rules, and instructions lawfully issued by the relevant authorities.
You must not provide false information, misuse another person's account, or attempt to evade identity verification, applicable trading restrictions, or compliance controls.
7. Trading Accounts, Platforms, and Orders
Where available and authorized, Titan Capital may facilitate access to PMEX commodity futures trading through the trading platforms and arrangements applicable to its services.
Trading access may depend on account activation, exchange requirements, platform availability, and other operational conditions.
Orders are subject to the applicable exchange rules, instrument specifications, trading hours, price limits, margin requirements, system availability, and market conditions.
Submitting an order does not guarantee its acceptance, execution, execution price, or execution time.
Orders may be rejected, partially filled, delayed, cancelled, or otherwise handled in accordance with applicable exchange rules and platform procedures. Market movements, liquidity constraints, technical interruptions, and other factors may affect execution.
You are responsible for reviewing your orders, executed transactions, open positions, and account statements. If you identify a suspected error or discrepancy, notify Titan Capital promptly through its designated support or complaints channel.
Transaction corrections, cancellations, and dispute handling are subject to applicable exchange rules, contractual arrangements, and the procedures of the relevant parties.
You must not assume that an order has been cancelled, executed, or modified until its status has been confirmed through the applicable trading platform or authorized channel.
8. Trading Risks and No Guarantee of Returns
Commodity futures trading involves substantial risk and may not be suitable for every investor.
Futures contracts may involve leverage, which can magnify both gains and losses. Market prices can change rapidly in response to economic data, geopolitical developments, interest rates, currency movements, supply and demand, liquidity conditions, and other factors.
You may lose some or all of the funds committed to trading. Depending on the applicable contract terms, account arrangements, and legal requirements, you may also have obligations arising from losses, margin shortfalls, or unsettled transactions.
Past performance, historical prices, market commentary, educational materials, and illustrative examples are not reliable guarantees of future results.
Titan Capital does not guarantee profits, returns, capital preservation, successful trade execution, or protection against market losses.
You should assess your financial circumstances, objectives, risk tolerance, and understanding of futures trading before participating.
Please also review the separate Risk Disclosure document available on our website.
9. Margin Requirements and Liquidation
Commodity futures trading is subject to applicable initial margin, maintenance margin, variation margin, settlement, and other financial requirements established under the relevant exchange framework and account arrangements.
You are responsible for maintaining the required margin and meeting applicable payment obligations within the prescribed time limits.
Margin requirements may change in response to market volatility, exchange decisions, instrument specifications, regulatory requirements, or other relevant circumstances.
Where required margin is insufficient, you may be required to deposit additional funds or reduce your exposure in accordance with the applicable procedures.
Positions may be subject to liquidation, close-out, restrictions, or other risk-management measures where permitted or required by applicable rules and contractual arrangements.
Liquidation may occur at an unfavorable price and may result in substantial losses. You should not assume that you will always receive advance notice or have an opportunity to provide additional funds before a position is liquidated.
The precise margin thresholds, notification procedures, liquidation mechanisms, and settlement obligations are governed by the applicable PMEX rules, client agreements, and operational procedures. This website does not establish independent margin thresholds or override those requirements.
10. Brokerage Charges, Fees, and Taxes
Brokerage commissions and other applicable charges may arise from trading and related services.
Depending on the applicable transaction and service, charges may include brokerage commissions, exchange fees, clearing or settlement charges, taxes, statutory deductions, and other disclosed charges.
The applicable rates, calculation methods, payment obligations, and deductions will be communicated through the relevant fee schedule, client agreement, account documentation, or other authorized disclosure.
You are responsible for reviewing the charges applicable to your account and transactions before trading.
Titan Capital will not represent a fee or tax rate as applicable unless it has been established for the relevant service and transaction.
Changes to charges will be communicated in accordance with applicable contractual, legal, and regulatory requirements.
Nothing in this section establishes a specific commission rate or fee schedule where one has not been separately disclosed.
11. Deposits, Withdrawals, and Client Funds
Client trading funds must be deposited through the applicable authorized channels into the client's designated PMEX trading account or other account specifically prescribed under the applicable arrangements.
Titan Capital does not invite clients to transfer trading capital into an ordinary Titan Capital corporate operating account for the purpose of funding their personal PMEX trading positions.
Clients should independently verify payment instructions through an authorized channel before making a transfer. You should not transfer funds to an individual or an account merely because the recipient claims to represent Titan Capital.
Deposits, withdrawals, transfers, settlement, and the availability of funds are subject to applicable PMEX procedures, account arrangements, verification requirements, banking processes, and applicable law.
A withdrawal request may be subject to identity verification, compliance checks, settlement of outstanding obligations, and other requirements under the applicable procedures.
Titan Capital does not guarantee that every deposit or withdrawal will be processed instantly or within a specific time unless a relevant authorized procedure expressly provides otherwise.
If you suspect a fraudulent payment instruction or an unauthorized request for funds, contact Titan Capital promptly through a verified contact channel.
12. Anti-Money Laundering, Customer Due Diligence, and Compliance
Titan Capital may conduct identity verification, customer due diligence, source-of-funds checks, sanctions screening, transaction monitoring, and other checks required by applicable laws, regulations, PMEX requirements, or its compliance procedures.
You agree to cooperate with reasonable verification requests and to provide accurate supporting documentation when required.
Where permitted or required by applicable law, Titan Capital may delay processing, restrict services, decline transactions, suspend account-related activities, or make reports to the relevant authorities.
Titan Capital may be prohibited by law from disclosing certain compliance checks, investigations, or reports.
These Terms & Conditions must be read together with the applicable AML/KYC Policy and client onboarding documentation.
13. Website Availability, Security, and Third-Party Services
We make reasonable efforts to maintain website availability and security. However, uninterrupted access cannot be guaranteed.
The website may occasionally be unavailable because of maintenance, upgrades, technical failures, connectivity issues, cybersecurity incidents, or circumstances beyond our reasonable control.
The website may contain links to third-party websites, trading platforms, or service providers. Such services may be subject to separate terms, privacy policies, and operational arrangements.
Unless expressly established otherwise, a third-party link does not constitute an endorsement by Titan Capital.
You are responsible for reviewing the applicable terms of third-party services before using them.
Website availability does not guarantee the availability of a trading platform, exchange, banking channel, or other external service.
14. Limitation of Liability
Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.
Subject to that principle, Titan Capital will not be responsible for losses arising solely from circumstances outside its reasonable control, including interruptions to telecommunications, internet connectivity, external platforms, exchange systems, or banking services, to the extent permitted by applicable law.
Nothing in this section removes obligations imposed on Titan Capital by applicable law, regulatory requirements, exchange rules, or a binding client agreement.
Nothing in these Terms & Conditions should be interpreted as excluding liability for fraud, wilful misconduct, or other matters for which liability cannot lawfully be excluded.
The limitations in this section do not guarantee that a claim will be accepted or rejected. Liability will be determined in accordance with the applicable facts, contractual obligations, and law.
15. Indemnity
To the extent permitted by applicable law, you may be responsible for losses, liabilities, or reasonable costs directly arising from your unlawful use of the website, fraudulent conduct, unauthorized use of another person's credentials, or material breach of these Terms & Conditions.
This provision does not require you to indemnify Titan Capital for its own unlawful conduct or for any liability that cannot legally be transferred to you.
Any claim for indemnification remains subject to applicable law and the circumstances of the claim.
16. Suspension and Termination
Titan Capital may restrict access to the website or suspend or discontinue a website feature where reasonably necessary for maintenance, security, prevention of misuse, or compliance with applicable law.
Access to brokerage services or a trading account may be restricted, suspended, or terminated only in accordance with the applicable client agreement, PMEX rules, regulatory requirements, and applicable law.
Where legally and operationally permissible, relevant communications or notices will be provided through the applicable channel.
Suspension or termination does not automatically extinguish outstanding financial obligations, settlement requirements, or other obligations that survive termination under the applicable agreement or law.
The handling of open positions, unsettled transactions, and account balances will be governed by the relevant exchange rules, account arrangements, and applicable legal requirements.
17. Complaints and Dispute Resolution
Titan Capital aims to handle client complaints fairly and through an appropriate process.
If you have a complaint concerning our website, services, communications, account handling, or other brokerage-related matter, please submit it through the designated complaints channel published on our website.
Where possible, include your name, relevant contact information, a description of the issue, relevant dates, and supporting documentation. Do not include passwords or authentication codes.
Titan Capital will handle complaints in accordance with its applicable complaints procedures and legal or regulatory obligations.
Complaints concerning exchange transactions, trading records, or other matters involving PMEX may be subject to the applicable exchange procedures and escalation channels.
Where a complaint remains unresolved, you may use the relevant escalation mechanism or dispute-resolution forum available under applicable law and regulatory requirements.
Nothing in this section limits any statutory right or applicable regulatory complaint mechanism.
18. Privacy and Personal Information
Personal information submitted through our website or during account opening may be processed for purposes such as responding to enquiries, assessing account applications, verifying identity, providing services, maintaining records, meeting legal and regulatory obligations, and protecting the security of our operations.
Personal information will be handled in accordance with applicable law and the Privacy Policy, where published.
You should not submit sensitive personal information through a general website enquiry form unless the form specifically requests it through an appropriate and secure process.
For details about the collection, use, retention, protection, and disclosure of personal information, please refer to the applicable Privacy Policy.
19. Amendments to These Terms
Titan Capital may update these Terms & Conditions from time to time to reflect changes to its website, services, operational procedures, contractual arrangements, or applicable legal and regulatory requirements.
The updated version will be published on the website with an updated effective date where applicable.
Changes will take effect in accordance with the applicable legal requirements and any relevant contractual notice provisions.
Where required, material changes affecting existing clients will be communicated through the appropriate channel.
Your continued use of the website after an update constitutes acceptance of the revised website terms only to the extent that such acceptance is legally effective. This clause does not replace any separate consent, notice, or contractual variation requirement applicable to a client account.
20. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of the Islamic Republic of Pakistan, subject to applicable mandatory legal and regulatory requirements.
Any dispute arising from the use of this website will be addressed through the competent courts or other dispute-resolution mechanisms having jurisdiction under applicable law.
Disputes relating to brokerage services, trading accounts, or PMEX transactions may be subject to separate contractual provisions, exchange rules, and applicable regulatory dispute-resolution procedures.
Nothing in this section overrides a mandatory statutory forum, regulatory process, or dispute-resolution mechanism.
21. General Provisions
If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure or delay in exercising a right under these Terms & Conditions does not necessarily constitute a waiver of that right.
These website terms do not replace any separately executed client agreement, prescribed account-opening document, or applicable exchange rule.
These Terms & Conditions should be read alongside the other applicable legal documents published by Titan Capital.
22. Contact Information
For general enquiries, please contact Titan Capital through the contact details published on our official website.
